These Terms & Conditions ("Terms") apply to your use of the containerspace.co.nz website ("Website") and to any purchase made through our online store. The Website is operated by Container Space NZ Limited (company number 9023272, NZBN 9429051780289), trading as Container Space ("Container Space", "we", "us", "our").
By using the Website or placing an order, you agree to these Terms. Please read them carefully before you buy. If you do not agree, please do not use the online store.
1. What these Terms cover
These Terms apply to products purchased online through the Website, including selected shipping containers and accessories such as container locks ("Products").
These Terms do not apply to container hire or leasing, container modifications, delivery services, or any goods or services quoted or sold outside the online store. Those are covered by a separate written agreement or quote, which will prevail over these Terms if there is any inconsistency.
Information on the Website about hire, modifications, delivery and other services is general information only and does not form an offer or contract.
2. Placing an order
Placing an order is an offer by you to buy the Products in your cart. A contract is formed only when we accept your order and confirm it by email, or when we take payment, whichever happens first.
We may decline or cancel any order (including after confirmation) if the Product is unavailable, if there is a pricing or description error, if we suspect fraud, or if we cannot verify your details. If we cancel, we will refund any amount you have paid in full.
You must be 18 or over, and provide accurate and complete information when ordering. If you are ordering on behalf of a business, you confirm you are authorised to do so.
3. Prices and payment
All prices are in New Zealand dollars and include GST unless stated otherwise.
Container prices do not include delivery or transport. Containers purchased online are for collection only (see clause 5). For accessories such as padlocks and lock boxes, shipping is as advertised on the Website and is included in the price shown (see clause 7).
We make every effort to keep prices accurate, but errors can occur. If a Product is listed at an incorrect price, we will contact you and you may choose to proceed at the correct price or cancel for a full refund.
Payment must be made in full at the time of ordering using the payment methods offered at checkout. Payments are processed by third-party payment providers; we do not store your full card details.
Our Price Match Guarantee, where offered, applies on the conditions set out on the Website and is not automatically applied to online orders. Contact us before ordering if you would like a price match.
4. Product descriptions and condition
Photos, dimensions and descriptions on the Website are a guide only. Images may be representative of the type of container rather than the exact unit you will receive.
Used containers have been in service and will show signs of age and use, such as dents, scratches, surface rust, faded or mismatched paint, old markings and signage, and repairs. These are normal for used containers and are not defects. Grades such as "cargo worthy" or "wind and water tight" are described on the Website and refer to the condition at the time of sale.
Unless we agree otherwise in writing, containers are not guaranteed to be suitable for any particular purpose (for example, habitation, storage of specific goods, dangerous goods, food storage or export shipping). If you need a container for a specific purpose, please tell us before you buy.
Stock is sold subject to availability. If a Product becomes unavailable after you order, we will offer you a comparable alternative or a full refund.
5. Collection only (no delivery)
All containers purchased online are collection only from the Container Space yard or depot specified on your order confirmation. Delivery is not included. If you would like delivery, please contact us for a separate quote before ordering.
Once your order is confirmed and paid, we will contact you to arrange a collection time. Collection is by appointment only during our normal yard hours.
You must collect your Product within 21 days of our confirmation that it is ready. After that, we may charge a storage fee of $1.50 per day, and if the Product is not collected within 60 days after we have made reasonable attempts to contact you, we may cancel the order and refund the purchase price less reasonable storage and administration costs.
You are responsible for either accepting our agreed transport solution or arranging and paying for suitable transport yourself. Your transport operator must have an appropriate vehicle (such as a Hiab, tilt-tray, swing-lift or flat-deck truck rated for the container's weight and size), and is responsible for securing the load, complying with all road transport rules, and delivering the container safely. If you arrange your own transport, depot fees may apply.
If we assist with loading at our yard, we do so as a courtesy. Our staff may refuse to load onto any vehicle they consider unsafe or unsuitable. Once the Product is loaded onto your vehicle, we are not responsible for its transport, unloading or placement.
Anyone collecting on your behalf must provide your order number and may be asked for identification. Anyone entering our yard must follow our site health and safety instructions at all times.
6. Inspection, risk and ownership
You are welcome to inspect the container before collection. Please check the Product carefully when you collect it and let us know of any concerns before it leaves the yard.
Risk in the Product passes to you when it is loaded onto your (or your transport operator's) vehicle, or when it leaves our yard, whichever is earlier. For accessories, risk passes when they are delivered to your address or collected by you.
Ownership of the Product passes to you only once we have received full payment in cleared funds.
7. Accessories (locks and other items)
Accessories such as padlocks and lock boxes are shipped to your New Zealand delivery address as advertised on the Website, with shipping included in the price shown. Accessories are held at our Mount Maunganui yard, and you may also collect them together with a container order.
Delivery timeframes for accessories are estimates only. Please check your order when it arrives and let us know of any damage or missing items within 7 days.
Lock boxes, padlocks and similar security products are designed to deter unauthorised access. No security product can guarantee protection against theft or forced entry, and we are not responsible for any loss of, or damage to, items stored in a container.
8. Cancellations, returns and refunds
Change of mind: You may cancel your order for a full refund at any time before collection by contacting us. Once a container has been collected, we do not accept returns for change of mind. Unused accessories in their original packaging may be returned within 14 days of purchase for change of mind; you are responsible for any return costs.
Faulty or not as described: Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If a Product is faulty or not as described, please contact us as soon as possible with your order number and photos, and we will work with you on a repair, replacement or refund as required by law.
Refunds are paid to the original payment method, usually within 5–10 working days of being approved.
9. Business purchasers
If you are acquiring Products for the purposes of a business, you agree that the Consumer Guarantees Act 1993, and sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986, do not apply, and that it is fair and reasonable for the parties to be bound by this clause. In that case, our liability for any Product that is faulty or not as described is limited, at our option, to repairing or replacing the Product or refunding the price paid.
10. Your responsibilities after purchase
You are responsible for ensuring you have the right to place a container on your chosen site and for obtaining any consents or approvals required (for example, building or resource consent, or landlord or body corporate approval).
You are responsible for preparing a suitable, level and stable site, and for the safe use, placement and maintenance of the container.
Any modification to a container after purchase is at your own risk and may affect its structural integrity, weather-tightness and value.
11. Limitation of liability
To the extent permitted by law, we are not liable for any indirect or consequential loss, loss of profit, loss of use, or loss of or damage to goods stored in a container, however caused.
To the extent permitted by law, our total liability to you in connection with any order is limited to the price you paid for the Product concerned.
Nothing in these Terms excludes or limits any liability or right that cannot be excluded or limited under New Zealand law, including your rights as a consumer under the Consumer Guarantees Act 1993.
12. Website information and use
Information on the Website, including guides, FAQs, specifications and blog content, is general information only and is not professional, engineering, building or legal advice. Please get specialist advice for your circumstances.
We aim to keep the Website accurate and available, but we do not guarantee that it will be error-free, uninterrupted or free of viruses.
Links to third-party websites are provided for convenience only. We are not responsible for their content or practices.
All content on the Website, including text, images, logos and design, is owned by or licensed to Container Space and may not be copied or used without our written permission.
You must not misuse the Website, including by attempting to gain unauthorised access, interfering with its operation, or submitting false orders.
13. Privacy
We collect and use your personal information to process your order, arrange collection, provide customer support and, if you agree, to send you updates and offers. We handle personal information in accordance with the Privacy Act 2020. See our Privacy Policy for more information, including how to request access to or correction of your information.
14. General
We may update these Terms from time to time by posting a new version on the Website. The Terms in force at the time you place your order apply to that order.
If any part of these Terms is found to be unenforceable, the rest of the Terms continue to apply.
These Terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction.
